Política de Confidencialidad y Protección de Datos Personales

T&A Consultores, es titular de los Sitios Web www.tyaconsultores.com; www.tyaonline.com (en adelante el Sitio) y responsable de los archivos generados con los datos de carácter personal suministrados por los usuarios a través de los mismos.

Todos los datos personales recopilados con la utilización que Usted haga de los mismos se tratarán de conformidad con la “Política de Confidencialidad y Protección de Datos Personales” de T&A Consultores.

T&A Consultores garantiza la privacidad y confidencialidad de los Datos de Carácter Personal proporcionados por sus titulares (en adelante “el Titular de los Datos Personales”) de conformidad con lo establecido en el Artículo 43, párrafo tercero de la Constitución Nacional, en la Ley N° 25.326 de Protección de Datos Personales, en el Decreto N° 1558/2001 y en la Disposición 11/2006 de la Dirección Nacional de Protección de Datos Personales.

La utilización de este sitio y/o la habilitación de una cuenta de usuario por el Titular de los Datos Personales importan la aceptación de la Política de Confidencialidad y Protección de Datos Personales. En caso de no estar de acuerdo con la misma, por favor, no use este sitio o solicite la cancelación de su cuenta de usuario.

Ámbito de aplicación.

La “Política de Confidencialidad y Protección de Datos Personales” de T&A Consultores se aplica sólo a este, no así a los sitios de terceros a los que los usuarios accedan por medio de links. T&A Consultores le sugiere que en estos casos se informe acerca de la política adoptada en cada uno de esos sitios.

El acceso a los vínculos de cualquier otro sitio o página quedará bajo su exclusiva responsabilidad y T&A Consultores no asume responsabilidad alguna por los daños que pueda causar dicha vinculación.

Tipo de información recolectada.

1. T&A Consultores podrá obtener información anónima acerca de las visitas a esta página. Se considera información anónima toda aquella que no pueda ser asociada a un usuario concreto e identificado, como por ejemplo la fecha y hora de acceso al sitio, las secciones consultadas, etc.
2. T&A Consultores se reserva el derecho de exigir la creación de una cuenta de usuario para acceder a determinados servicios y contenidos y de subordinar la habilitación de la misma al suministro de ciertos datos personales del usuario.

Los usuarios que opten por registrarse deberán brindar información exacta y completa acerca de sus datos personales.

Ud. es único y exclusivo responsable por los daños y perjuicios que se puedan derivar del Incumplimiento de las obligaciones anteriores.

Los datos personales que se recabarán de los usuarios registrados son, únicamente, aquellos brindados libre y voluntariamente por el Titular de los Datos Personales al momento de la creación de la cuenta de usuario o posteriormente.

T&A Consultores no almacenará datos personales de los usuarios del sitio que no sean brindados de esa manera.

A los fines de conservar una constancia por escrito o medio equivalente del consentimiento del titular de los datos personales antes de la habilitación de la cuenta de usuario se le exige que preste conformidad haciendo un clic en el botón que contiene la leyenda “Acepto la Política de Confidencialidad y Protección de Datos Personales” de T&A Consultores.

3. Cualquier información, con excepción de datos o información personal, que los usuarios transmitan a T&A Consultores a través de esta página, correo electrónico o de otra manera, incluyendo datos, preguntas, comentarios o sugerencias, serán tratados como información no confidencial y se convertirán en propiedad de T&A Consultores. Esta información, con excepción de datos o información personal, podrá ser utilizada para cualquier propósito, lo que incluye: reproducción, solicitud, acceso, transmisión, publicación y difusión. T&A Consultores es libre de utilizar cualquier idea, concepto, conocimiento técnico, o técnica contenida en cualquier comunicación que usted envíe a T&A Consultores vía este sitio o por cualquier otro medio para cualquier propósito, lo cual incluye el desarrollo y comercialización de productos.

4. T&A Consultores en ningún caso procederá al registro de los llamados datos sensibles de los usuarios de la página web. Se entenderán por datos sensibles aquellos datos personales que revelan el origen racial y étnico, las opiniones políticas, las convicciones religiosas, filosóficas o morales, la afiliación sindical o información referente a la salud o a la vida sexual de sus usuarios.

Uso de la información y tratamiento de los datos personales.

T&A Consultores usará los datos recabados con la finalidad de mantener informados a los usuarios acerca de sus acciones, para proporcionar en forma más eficaz los servicios que los usuarios soliciten.

T&A Consultores garantiza a los usuarios que no estuvieran de acuerdo con las finalidades para las cuales recaba los datos o con alguna de las finalidades para las cuales se utilizarán en el futuro, de las que serán debidamente informados, el derecho de obtener la supresión de los mismos de su base de datos.

T&A Consultores no revelará la información provista a ninguna organización externa, a menos que previamente posea la autorización del usuario y/o le sea requerida por ley o por resolución de autoridad competente.

T&A Consultores garantiza que no venderá, alquilará, transferirá ni cederá los datos personales de sus usuarios o visitantes a terceros sin su expreso consentimiento.

Derecho de acceso, rectificación y supresión de los datos registrados.

T&A Consultores reconoce al Titular de los Datos Personales, previa acreditación de su identidad, el derecho a solicitar y a obtener información sobre sus datos personales incluidos en sus registros, dentro de los diez días hábiles desde la solicitud, de conformidad con lo establecido en el artículo 14, inciso 3 de la Ley 25.326 de protección de Datos Personales.

T&A Consultores garantiza también al Titular de los Datos Personales el derecho a obtener la rectificación, actualización y, cuando corresponda, la supresión de los datos personales de los que sea titular, que estén incluidos en su banco de datos y garantiza la rectificación, supresión o actualización de los mismos en el plazo máximo de cinco días hábiles de recibido el reclamo del titular de los datos o advertido el error o falsedad.

En cumplimiento de la disposición 10/2008 de la Dirección Nacional de Protección de Datos Personales se hace saber que:

El Titular de los Datos Personales tiene la facultad de ejercer el derecho de acceso a los mismos en forma gratuita y en intervalos no inferiores a seis meses, salvo que acredite un interés legítimo al efecto, conforme con lo establecido en el artículo 14, inciso 3 de la Ley N° 25.326.

Los derechos de acceso y rectificación de datos, se deberán ejercer a través de: Carta Documento dirigida a T&A CONSULTORES – AV. DEL LIBERTADOR 4980 – 3º “B” – CABA (1426) – REPUBLICA ARGENTINA.

En caso de incumplimiento de esta obligación por parte de T&A Consultores dentro del término mencionado habilita el ejercicio de la acción de protección de los datos personales o de hábeas data prevista en la Ley 25.326 de Protección de Datos Personales.

La Dirección Nacional de Protección de Datos Personales, Órgano de Control de la Ley Nº 25.326 tiene la atribución de atender las denuncias y reclamos que se interpongan con relación al incumplimiento de las normas sobre protección de datos personales. T&A Consultores podrá denegar el acceso, rectificación o la supresión de los datos personales registrados únicamente por las causas previstas en la Ley de protección de Datos Personales.

Nivel de seguridad y Responsabilidad.

T&A Consultores se compromete a realizar sus mejores esfuerzos considerando la tecnología disponible a efectos de proteger y mantener a salvo y conforme a niveles de protección adecuados la información personal que Usted ingrese. Para ello ha adoptado medidas de seguridad que protegen dicha información

Sin perjuicio de todo lo expuesto, teniendo en cuenta que las medidas de seguridad en Internet no son inexpugnables, no puede garantizarse seguridad absoluta, por lo que T&A Consultores no se responsabiliza de cualquier daño y/o perjuicio y/o beneficios dejados de percibir por el Titular de los Datos Personales o cualquier otro tercero que se vea perjudicado en ese sentido.

Jurisdicción y Legislación Aplicable.

El presente acuerdo sobre el tratamiento de los datos personales de los usuarios del sitio web de T&A Consultores se rige por las leyes de la República Argentina. Cualquier disputa o reclamo que surja con relación al mismo, incluyendo cualquier disputa sobre la validez, interpretación, exigibilidad o incumplimiento serán exclusivamente resueltas por la Justicia Nacional Ordinaria en lo Comercial de la Ciudad Autónoma de Buenos Aires de la República Argentina.

Jurisdiction and Applicable Legislation.

This agreement on the treatment of personal data of users of the T&A Consultores website is governed by the laws of the Argentinian Republic. Any dispute or claim that arises in relation to it, including any dispute on the validity, interpretation, enforceability or non-compliance will be exclusively resolved by the Ordinary National Justice in Commercial matters of the Autonomous City of Buenos Aires of the Argentinian Republic.
